ENGINEER'S CERTIFICATES - AUTHORITY LEGALIZATIONS

Engineer's certificate

According to Law N.4495/17, every transfer of property must be accompanied by an engineer's responsible statement. In this statement the undersigned engineer confirms that there is no planning violation on the property and it has been constructed in accordance with his building permit. The engineer's certificate is also required for land transfers.

 

The certificate is valid for two (2) months and is submitted to the electronic system of T.E.E. before signing contracts. Each certificate has a unique number related to the specific property and is attached to the contract.

To issue a certificate, the following supporting documents are required:

 

- Building permit

 

- Ownership certificate

 

– Approved architectural plans

 

– Legalizing documents of settlements / arrangements

The procedure followed for the issuance of an engineer's certificate is as follows:

– Autopsy at the property,

 

– Urban control and legality control of the property

 

– Issuance of the certificate

Legalization of Improperty Rights

The legalization of arbitrary is the process by which, after paying the single special fine or the relevant fee, it is possible to legalize arbitrary constructions and/or uses, which are proven to have been built before July 28, 2011. A construction or a use is considered arbitrary when there is no building permit or, if there is (a building permit) it was not implemented as provided for in the approved town planning plans.

 

The settlement of an arbitrariness is necessary for every legal act in life, i.e. sale, donation or parental provision as well as for the issuance of an engineer's certificate on the legality of the property.

 

Today Law 4495/2017 is in force for the settlement of arbitrary and declarations are made electronically through the information system of T.E.E.

The main supporting documents required for the procedure are the following:

 

- Building permit,

 

- Responsible declaration of Law 1599/86

 

– Architectural floor plan, section drawings and coverage diagram

 

- Topographical,

 

– Engineer's technical report

 

Depending on the case of each building, additional documents and supporting documents are required, which the engineer finds out when he surveys the property.

The fine is calculated taking into account various parameters, such as the square footage of the building, the zone price as well as some additional information, such as the type of use of the building, if it is within a plan etc.

The procedure is as follows:

 

– Detailed description of the property

 

– Finding the best possible solution, in accordance with the applicable legislation, to reduce the fines and calculate the fine.

 

- Compilation of a technical report / Informing the owner about the arbitrary constructions that exist, the amount of the fine and the tax and the repayment possibilities that the owner of the property has.

 

- Elaboration of a study and design for the purpose of posting / submitting to the electronic system of T.E.E. and preparation of a Structural Vulnerability Bulletin.

 

– Completion of the process and delivery of the file with all the necessary sheets to the owner

Some general information regarding the legalization of a construction:

 

– There are five (5) categories of arbitrary constructions and/or uses,

 

– The Law is divided into two phases: in the first two there is a discount and in the next two there is an increase in the special single fine,

 

– A 20% discount is provided for a one-time payment of the fine and a 10% discount for a one-time payment of 30% of the fine,

 

– There are special discounts for the disabled, the long-term unemployed and those with many children,

 

– The parabola in favor of the State is scalable and depends on the quadratics,

 

– The fine can be paid in up to 100 monthly installments, with a minimum amount of €50,

 

– The arbitrary regulation is valid for 30 years,

 

– There are cases of constructions for which legalization cannot be done.
